Acceptable Use Policy

Effective Date: February 1st, 2026

This Acceptable Use Policy ("AUP") governs the use of telecommunications services (the "Services") provided by Peninsula Fiber Network and its affiliates (“PFN,” "Provider," or "Company,"). This AUP applies to all customers using PFN’s network, including carriers, businesses, and government users and resellers ("Customer," “End User,” or “Reseller”). This AUP is published to satisfy the certifications made by PFN in the FCC Robocall Mitigation Database (RMD) pursuant to 47 C.F.R. § 64.6305 and related FCC orders and is incorporated by reference into the company’s service agreements and tariffs.

Purpose and Scope

Peninsula Fiber Network is committed to preventing illegal robocalling, spoofing, fraud, and other abuses of the Company’s network for the unlawful use of the Public Switched Telephone Network (PSTN). This AUP defines examples of acceptable and prohibited uses of the Company’s services, robocall mitigation efforts, enforcement and remedies.

Compliance with Law and Regulation

The Customer agrees to use the Services in full compliance with:

  • All applicable federal, state, and local laws and regulations;

  • FCC rules and orders, including but not limited to the Telephone Consumer Protection Act (TCPA), Truth in Caller ID Act, and robocall mitigation requirements;

  • STIR/SHAKEN authentication requirements where applicable; and

  • Any additional obligations imposed by Provider’s upstream carriers or numbering authorities.

The Customer is solely responsible for ensuring that calling campaigns, equipment, software, and end user practices comply with all applicable legal requirements.

Prohibited Uses

The following activities are strictly prohibited and constitute a violation of this AUP:

  • Illegal or Abusive Calling

  • Initiating or facilitating illegal robocalls, including calls made without required consent;

  • Transmitting calls using an autodialer or artificial or prerecorded voice in violation of the TCPA;

  • Engaging in telemarketing practices that violate federal or state do not call rules;

  • Generating calls with the primary purpose of harassment, intimidation, or abuse.

Caller ID Spoofing and Misrepresentation

  • Transmitting misleading, inaccurate, or falsified Caller ID information;

  • Spoofing telephone numbers with the intent to defraud, cause harm, or wrongfully obtain value;

  • Using numbers not assigned or lacking lawful authorization.

Fraud and Scam Activity

  • Calls related to phishing, vishing, IRS scams, tech support scams, or other fraudulent schemes;

  • Calls designed to deceive recipients into providing personal, financial, or authentication information;

  • Traffic patterns indicative of high volume scam or fraudulent behavior.

Network Abuse

  • Generating excessive or anomalous call volumes inconsistent with stated use case;

  • Attempts to evade call analytics, blocking, labeling, or traceback mechanisms;

  • Reselling or re routing traffic in a manner inconsistent with the service agreement or disclosed business model.

Customer Representations and Obligations

By using the Services, the Customer represents and warrants that:

  • There is a legitimate business purpose for originating or transmitting calls;

  • The Customer maintains policies, procedures, and controls to prevent illegal robocalling and spoofing;

  • The Customer will fully cooperate with PFN, regulators, and industry traceback efforts, including those coordinated by USTelecom’s Industry Traceback Group (ITG);

  • The Customer will promptly provide accurate information regarding call campaigns, traffic sources, and end user identities upon reasonable request.

Robocall Mitigation Program Alignment

Peninsula Fiber Network maintains a robocall mitigation program consistent with its RMD certification. As part of this program:

  • PFN deploys reasonable measures to detect and mitigate suspected illegal robocall traffic;

  • Traffic may be monitored, analyzed, and investigated using call analytics and other tools;

  • PFN may block, label, suspend, or restrict traffic reasonably believed to be illegal, fraudulent, or abusive;

  • PFN may require Customers to implement corrective actions or provide additional attestations regarding calling practices.

Peninsula Fiber Network’s mitigation measures may evolve over time to align with FCC guidance, industry best practices, and emerging threats.

Enforcement and Remedies

  • Peninsula Fiber Network reserves the right, without prior notice, to take one or more of the following actions if a violation of this AUP is suspected or confirmed:

  • Temporarily suspend or permanently terminate Services;

  • Block or restrict specific traffic or telephone numbers;

  • Require remediation plans or additional documentation;

  • Report suspected unlawful activity to upstream providers, analytics partners, traceback groups, or government authorities;

  • Update RMD certifications or related disclosures as required.

Enforcement actions may be taken immediately where necessary to protect the network or comply with legal obligations.

No Waiver and Reservation of Rights

Failure by Peninsula Fiber Network to enforce any provision of this AUP shall not constitute a waiver of PFN’s right to enforce such provision in the future. Peninsula Fiber Network reserves all rights not expressly granted herein.

Modifications to This Policy

Peninsula Fiber Network may modify this AUP at any time by posting an updated version on its website. Continued use of the Services after such posting constitutes acceptance of the revised AUP.
